Judge dismisses legal challenge to CCG consultation - response from Healthwatch Oxfordshire


A judge at the High Court has today (December 21) dismissed the legal challenge to Oxfordshire Clinical Commissioning Group's consultation process.

The challenge had been brought to London’s High Court by Cherwell District Council, with support from South Northamptonshire Council, Stratford-on-Avon District Council and Banbury Town Council acting as co-claimants.

The claimants had called for a judicial review because they believed the consultation process was flawed.

In a statement on Cherwell District Council's website, Cllr Barry Wood, leader of Cherwell District Council, said: “Cherwell District Council and its partner councils in the judicial review relating to the Horton General Hospital are bitterly disappointed by the judgement from our legal challenge. The council is very aware of the significant concern of local people about the withdrawal of acute services at our local hospital and felt that a legal challenge was an appropriate action to take to reflect the extent of that concern."

David Smith, Chief Executive of Oxfordshire Clinical Commissioning Group said: “We are pleased the judge has made the decision in favour of OCCG. His quick ruling has supported what we have always believed was a well conducted consultation on proposals to make urgent changes to some Oxfordshire health services, based entirely on safety and quality of patient care.

“We are however, mindful that the campaign group and the district councils were unhappy with the consultation and its outcomes and felt strongly enough to take legal action. We will take away learning from this experience and how we work with our local communities and local authorities in Oxfordshire as well as neighbouring areas to the benefit of our patients in the future.”

“We understand the strength of feeling among local people, especially those who live in the north of the county; but we firmly believe the decisions we made will ensure safe and sustainable patient care for now and the future.”

The focus now for the clinical commissioning group should be to engage with all those involved to deliver safe, sustainable health services for the people of Oxfordshire."
